1) Purpose & Scope

These Terms govern your use of our website, showroom, sales, and in-house financing (Buy Here Pay Here, “BHPH”). By applying for credit or buying a vehicle, you agree to these Terms and all applicable laws, including the Utah Consumer Credit Code and relevant FTC rules.

2) Definitions

• Dealer/We/Us: Tint & Detail Shop LLC, dba T&D Automotive.
  
  
• You/Buyer: The applicant(s)/customer(s).
  
  
• Agreement: These Terms + any signed Retail Installment Contract (RISC), buyer’s order, warranty/service contracts, and ancillary consents.
  
  
• Vehicle: The financed automobile and all accessories.
  
  

3) Eligibility & Approval

Approval is not guaranteed and is subject to our underwriting standards, including verification of:

• Government ID & SSN/ITIN, residency, employment/income, references;
  
  
• Insurance eligibility; vehicle availability/value; and prior account history.
  False, incomplete, or unverifiable information may result in denial or rescission.
  
  

4) Credit Authorization (FCRA)

You authorize us to:

• Obtain and use consumer reports (credit reports), employment/income verification, residence and reference checks;
  
  
• Share information with credit bureaus and permissible third parties for underwriting, account servicing, collections, and fraud prevention.
  
  

5) Equal Credit Opportunity (ECOA) Notice

We do not discriminate on a prohibited basis (race, color, religion, national origin, sex, marital status, age, receipt of public assistance, or exercise of CCPA/FCRA rights). If credit is denied, you may receive an Adverse Action Notice explaining key reasons and your rights to a free credit report.

6) E-SIGN Consent (Electronic Records)

By applying online or signing electronically, you consent to transact electronically and receive disclosures/notices by email or website. You may withdraw consent at any time by contacting Finance@tdauto1.com; withdrawal may delay processing and require paper signatures.

7) TCPA/Email/SMS Consent

You consent to us (and our service providers) contacting you at the numbers/emails you provide—including autodialed, prerecorded, text/SMS, and email communications—about applications, accounts, collections, and promotions. Message/data rates may apply. Opt-out at any time by replying STOP to texts or emailing Finance@tdauto1.com.

8) Payment Terms & Fees

• Your RISC states APR, finance charges, term, installment amounts/due dates, and total of payments under TILA.
  
  
• Late Fee: Up to 20% of the installment (or the maximum permitted by Utah law) after 10 days past due.
  
  
• NSF/Returned Payment Fee: $35 or the legal maximum.
  
  
• Default: Typically 15 days past due, insurance lapse, or other contractual breach.
  
  
• All payments are non-refundable and must be in USD by approved methods (cash, ACH, card, or certified funds).
  
  

9) ACH/Debit Authorization (Optional but Recommended)

If you opt in to AutoPay, you authorize recurring ACH/debit card charges for your installments and applicable fees. You may revoke AutoPay at any time at least 3 business days before the next scheduled debit by emailing Finance@tdauto1.com. Returned/declined payments incur fees and may trigger default.

10) Ownership, Title & Security Interest

We retain a purchase-money security interest in the Vehicle until your contractual balance is paid in full and funds clear. Title transfers only upon full satisfaction of your account.

11) Vehicle Condition; Warranties; Buyer’s Guide

• Unless expressly stated in writing, vehicles are sold “AS IS” with no warranty, or with any limited warranty/service contract expressly listed on the FTC Buyer’s Guide and purchase documents.
  
  
• No oral promises modify written terms. You are responsible for maintenance/repairs unless a written warranty/service contract says otherwise.
  
  

12) Insurance Requirement

• You must maintain full-coverage (comprehensive & collision) naming Tint & Detail Shop LLC, dba T&D Automotive as Loss Payee.
  
  
• Provide proof before delivery and thereafter upon request. Lapse is a default and may result in repossession or force-placed coverage at your expense (if offered).
  
  

13) Telematics/GPS & Starter-Interrupt (If Installed)

To reduce loss and aid recovery, certain BHPH vehicles may include GPS tracking and/or a starter-interrupt device:

• You consent to installation/use for anti-theft, account servicing, and recovery in case of default or theft.
  
  
• Devices are used consistent with Utah law and only for legitimate business purposes.
  
  
• Tampering/disabling devices is a contractual breach and may result in default.
  
  
• We do not monitor your driving behavior for insurance rating.
  
  

14) Default, Collections & Repossession

If you default, we may—consistent with Utah Code § 70A-9a-609—repossess the Vehicle without prior notice and without breach of the peace. You remain liable for:

• Deficiency balance (if sale proceeds are less than what you owe),
  
  
• Towing, storage, refurbishing, sale costs, and
  
  
• Reasonable attorney’s fees and collection costs as allowed by law.
  Personal property found in a repossessed Vehicle must be claimed within 10 calendar days of notice; storage/disposal fees may apply.
  
  

15) Military & Servicemember Protections (SCRA)

If you are on active duty and believe you may be entitled to Servicemembers Civil Relief Act protections, notify us immediately at Finance@tdauto1.com. We will review and apply any applicable relief.

16) Refunds, Cancellations & Returns

Deposits, documentation fees, and post-delivery payments are non-refundable. Pre-delivery cancellations must be in writing and are subject to administrative review.

17) Limitation of Liability

We are not liable for incidental, special, or consequential damages (e.g., loss of use, lost wages, inconvenience) arising out of vehicle purchase, financing, or service interruptions.

18) Indemnification

You agree to defend and hold harmless Tint & Detail Shop LLC, dba T&D Automotive and its personnel from claims arising out of your breach, misuse, or unlawful conduct related to the Vehicle or these Terms.

19) Dispute Resolution; Arbitration (with Opt-Out)

Any dispute arising out of or relating to the Agreement or your account may be resolved by binding arbitration on an individual basis (no class actions), under the rules of a recognized arbitral forum.

• Opt-Out: You may opt out of arbitration within 30 days of signing your RISC by emailing Finance@tdauto1.com with subject “Arbitration Opt-Out,” your full name, address, last 4 of SSN, and VIN.
  
  
• Venue and governing law remain State of Utah (Salt Lake County).
  
  
• Nothing prevents either party from seeking small-claims relief where eligible.
  
  

20) Changes to Terms

We may update these Terms at any time. Updates are effective upon posting to our site. Material changes to arbitration, fees, or data practices will be highlighted for notice.
